Website Terms of Use

1. Identification and acceptance

This website is operated by Prismond, a digital solutions agency providing custom software development, web systems, automations, AI assistants, online stores, websites and other technology services.

By accessing or using the Prismond website, visitors agree to these Terms of Use to the extent applicable to their use of the site. If you do not agree with these Terms, please do not use the website.

2. Informational nature of the website

The website is primarily informational and commercial. Its purpose is to explain Prismond’s services and make it easier for prospective clients to contact the agency.

Publishing a service, description, example, figure, illustrative case or response time does not by itself constitute a binding commercial offer.

Project proposals, prices, scope, deliverables, timelines, payment terms, warranties and other conditions will be established, where applicable, in a separate commercial proposal, work order or contract.

3. Illustrative cases and results

Success stories, examples, figures and situations displayed on the website may be illustrative and do not necessarily represent real clients.

Any figure or example used to explain a possible solution is provided for demonstration only and is not a promise of results for a particular business.

A stated “24 h” response time is a service goal and does not create a contractual obligation or guarantee that every inquiry will receive a response within that period.

4. Contact and communications

The website provides ways to contact Prismond through WhatsApp or email.

The contact form builds the message in the user’s browser and does not directly submit it to a Prismond server. The user decides whether to send the message through the available channel.

Personal data processing is governed by Prismond’s Personal Data Processing and Privacy Policy, available on the Privacy policy page.

5. Intellectual property

Unless stated otherwise, the Prismond brand, graphic elements, text, design, structure, source code, interfaces, images and other original website content belong to Prismond or are used with the appropriate authorization.

You may not copy, reproduce, modify, distribute, publish, extract or commercially exploit such content without prior authorization, except where applicable law expressly permits the use.

Ownership, licensing, assignment or other rights concerning software developed for clients will be determined exclusively by the contract or proposal applicable to each project.

6. Permitted and prohibited use

Visitors may use the website to learn about Prismond and its services and to contact the agency for legitimate purposes.

The following activities are prohibited:

  • Abusive scraping or automated requests that adversely affect the website.
  • Impersonating another person or organization.
  • Attempting to gain unauthorized access to systems, servers or website resources.
  • Introducing code, files or requests intended to affect the site’s availability, integrity or security.
  • Using the website for unlawful activities or in violation of these Terms.

The website may contain links to WhatsApp, social media platforms or other third-party services.

Those services are independent from Prismond and have their own terms of use, privacy policies and data practices. Prismond does not control their operation, availability or content.

8. Availability and liability

Prismond will make reasonable efforts to keep the website available and functioning properly, but does not guarantee continuous, uninterrupted or error-free availability.

The website may be modified, temporarily suspended or removed for maintenance, updates, security measures, infrastructure changes or circumstances beyond Prismond’s reasonable control.

Website information is provided for general informational purposes. Prismond is not responsible for decisions made solely on the basis of general website information without a specific assessment or engagement for the relevant service.

Nothing in these Terms is intended to exclude or limit rights or liabilities that cannot legally be excluded or limited.

9. Contracted services

Using the website does not by itself create a contract for software development or other services.

When a client engages Prismond for a project, the applicable contractual document will establish the specific terms. If these Terms conflict with a specific client contract, the specific contract will govern that contractual relationship.

10. Changes to these Terms

Prismond may update these Terms when the website, its services or applicable laws change.

The version published on the website will be the current version for use after publication. Previously executed contracts remain governed by their own terms.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Colombia.

Disputes relating to the website will be heard by the courts of the Republic of Colombia, without prejudice to mandatory territorial jurisdiction rules or consumer protection provisions that may apply.
